Terms of Service | KD Studios & Calibite

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and KD Studios, operated by Kiavash Davoodi (CVR: 41650788, Bagsværd, Capital Region of Denmark, 2880, Denmark), governing your access to and use of our website (https://kdstudios.app), our engineering services, and our mobile applications, including Calibite: AI Food Tracker & Meal Planner.

2. Studio Engineering Engagements & Milestone Protections

KD Studios offers fixed-scope launch sprints (such as the 2–3 week Rapid MVP Sprint) and dedicated retainer arrangements.

Written Scope & Acceptance Criteria: Prior to project kickoff, we agree in writing on the deliverables, sprint scope, timeline, and objective acceptance criteria for each milestone.
Written Milestone-One Guarantee: If Milestone 1 does not satisfy the written acceptance criteria, we correct the deliverables within the agreed review period. If it still does not satisfy the criteria, the engagement terminates immediately, and the client owes $0 for that milestone.
Intellectual Property Transfer: Upon receipt of full payment for approved deliverables, all custom application source code, designs, and architectural assets created specifically for the client are irrevocably assigned to the client.

3. Calibite Application Terms of Use

By downloading or using Calibite from the Apple App Store or Google Play Store, you agree to the following terms:

License Grant: We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use Calibite for your personal, non-commercial use on compatible devices.
Nutritional Information Disclaimer: Calibite provides nutritional estimates derived via computer-vision inference and food databases for informational and wellness tracking purposes only. Calibite is not a medical device, nor does it provide medical diagnosis or treatment. Consult a licensed physician or registered dietitian before undertaking any significant dietary changes.
In-App Subscriptions: Premium features may be offered via auto-renewing subscriptions processed through Apple App Store StoreKit or Google Play Billing. Billing terms, renewals, and cancellations are governed by the respective store policies.

4. Prohibited Uses

You agree not to decompile, reverse engineer, or disassemble the Calibite application or website infrastructure, bypass any rate limits or security measures, or use automated scrapers against our APIs without prior written consent.

5. Limitation of Liability & Governing Law

To the maximum extent permitted by applicable law, KD Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages. These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of Denmark, with the City Court of Copenhagen having exclusive jurisdiction.
